SMILECAB provides services based on the following terms and conditions, the service descriptions and the price lists. Deviating terms and conditions shall not apply, even if SMILECAB does not expressly object to them. Deviations from these conditions require the express written acknowledgment of SMILECAB. A contract shall only be valid if confirmed by SMILECAB.
The scope of services is determined exclusively by the written confirmation of order by SMILECAB or by subsidiary according to the written offer of SMILECAB. Information contained in prospectuses, performance catalogs, price lists and similar information is only binding to the extent that it is expressly referred to. The transport is carried out according to the provisions of the Road Traffic Regulations and the PbefG. Passengers must comply with instructions from SMILECAB or the chauffeur. If guests act in breach of the directives, or if they constitute a threat to the Road Traffic Regulations, or to the safety of road traffic due to impairments of the chauffeur, SMILECAB is entitled to exclude them from the transport. In this case, SMILECAB will charge the full fare including the fixed price or kilometer price and all additional and special services.
Any change to the agreed collection time, irrespective of the reason, shall be communicated immediately to SMILECAB. Damage caused by a non-immediate notification shall be borne by the customer. The chauffeur of SMILECAB is available at the agreed pick-up time at the respective meeting point of the airport terminal, or the previously agreed upon meeting point, with name badge or company logo (earlier or later provision to be specified when booking) and waits for up to 60 minutes without a separate calculation . A telephone number under which the passenger can reach his chauffeur is indicated in the confirmation letter. Should no contact be made with the passenger or the customer after the expiry of the 60-minute waiting period, the chauffeur will return to Vienna without a passenger. The performance of SMILECAB is then deemed to have been rendered and the full ticket price is due for payment. Further waiting times requested by the customer are calculated according to the valid price list.
The prices include the statutory value-added tax at the respective statutory rate. The prices valid on the day of booking confirmation apply. Prices not listed in the price list can only be agreed in writing and apply only for the agreed date of travel and rental period. Additional times and distances are calculated according to the valid price list. Additional costs due to delays will be borne by the customer, unless the delays are due to a fault of SMILECAB or the chauffeur. The price includes the transport of persons with normal luggage; The entrainment of bulky goods requires a separate agreement.
The fare is due at the time of delivery of our service at the end of the journey, unless otherwise agreed. As a rule, a cash payment is made directly with the driver. You will receive a receipt of the ticket. An invoice will be sent to the customer by mail if desired.
In the case of invoices and invoices, payments must be made without deduction within 14 days after receipt of the invoice. This does not apply if something else has been agreed. Cancellations will be effective only if they are made in writing or confirmed by SMILECAB in writing. For the timeliness of written cancellations, access to SMILECAB is available. Cancellations up to 24 hours prior to the scheduled start of the trip are free of charge.
The customer shall immediately notify SMILECAB of any change in his name or his (invoicing) address. Likewise, the customer is obligated to provide the necessary information on passengers, time and place of the service provision. If the customer fails to provide an immediate notification, he is liable for damages which would have been avoided in the case of timely notification. If a customer violates the aforementioned obligations, SMILECAB is entitled to take all necessary measures to eliminate the misuse. In the case of a culpable violation, the customer shall be liable for damages against SMILECAB.
SMILECAB shall be liable to the customer for damages - irrespective of the legal basis - only in case of willful intent or gross negligence as well as culpable violation of essential contractual obligations of SMILECAB, its legal representatives or vicarious agents. Liability for injury to life, body or health is governed by statutory provisions. In case of damage to property the liability of SMILECAB is limited to € 1,000,00 per passenger. The vehicles are subject to a liability breach according to the applicable general insurance conditions. The customer is responsible for any additional insurance. SMILECAB does not accept any liability for damage caused by incorrect transmission of data by the customer to the customer or passenger.
All legal relations between SMILECAB and its customer are subject exclusively to Austrian law. Place of jurisdiction and place of performance is Vienna.
Should one or more of the above conditions be invalid, the remaining conditions shall remain unaffected. Instead of ineffective clauses, the statutory provisions shall prevail.
